The nationwide injunction regarding enforcement of the BOI filing requirements, announced in early December 2024 – was lifted by a three-judge panel of the U.S. Court of Appeals for the Fifth Circuit on December 23, 2024. Three days later, on December 26, 2024 - the Fifth Circuit Court of Appeals reversed its own three-judge panel and reinstated the stay.
Therefore, reporting companies are not presently required to file their beneficial ownership information and will not be subject to liability if they fail to do so.
